Second Session, 44th General Assembly

BILL 40

AN ACT TO AMEND THE SERVICES CHARGES ACT

Received and Read the First Time

Second Reading

Committee

Third Reading

Royal Assent

HONOURABLE LLOYD MATTHEWS

Minister of Finance

Ordered to be printed by the Honourable House of Assembly

EXPLANATORY NOTES

Clause 1 of the Bill would repeal section 3 of the Services Charges Act to remove registration fees charged under the Condominium Act. The method of assessing those fees has changed and those fees no longer come under the purview of the Services Charges Act. Rather, they are addressed under the Condominium Act and regulations and a directive of the minister under that legislation.

Clause 2 of the Bill is a consequential amendment to the Condominium Act to allow the minister to prescribe fees and forms for the purpose and administration of that Act. This provision was inadvertently omitted from amendments stemming from the Regulatory Reform Project.
