EXPLANATORY NOTES Clause 1 of the Bill would amend the Occupational Health and Safety Act by updating the definitions of "assistant deputy minister" and "minister". Clause 2 of the Bill would amend the Act by changing the limitation period during which offences under the Act or regulations may be prosecuted. |
A BILL AN ACT TO AMEND THE OCCUPATIONAL HEALTH AND SAFETY ACT Analysis 1.

S.70 R&S Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows: RSNL1990 cO-3 1. (1) Paragraph 2(a) of the Occupational Health and Safety Act is repealed and the following substituted: (a) "assistant deputy minister" means an
assistant deputy minister appointed under section 9 of the Executive Council Act for the proper conduct of this Act; (2) Paragraph 2(g) of the Act is repealed and the
following substituted: (g) "minister" means the minister appointed under the Executive Council Act to administer this Act; 2. Section 70 of the Act is repealed and the
following substituted: Limitation period 70. A prosecution under this Act or the regulations shall be started within 2 years of (a) the date upon which the offence is alleged to have been committed; or (b) the date upon which an assistant deputy minister or an officer of the Occupational Health and Safety Division becomes aware of the alleged offence, whichever is later.
