EXPLANATORY NOTES

This Bill would amend the Provincial Court Act, 1991.

Clause 1 of the Bill would provide for a term of office of chief judge of 7 years.  The current term is 10 years.

Clause 2 of the Bill would provide for a term of office of the members of the complaints review committee, other than the chief judge, of 3 years, with eligibility to serve for further terms.

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

        1. Subsection 7(2) of the Provincial Court Act, 1991 is repealed and the following substituted:

             (2)  The term of office of the chief judge appointed under subsection (1) shall be 7 years.

 

        2. Section 19 of the Act is amended by adding immediately after subsection (2) the following:

             (3)  The term of office of the members of the committee referred to in paragraphs (1)(b) and (c) shall be 3 years and those members are eligible to serve for additional terms.
