EXPLANATORY NOTES

This Bill would amend the Consumer Protection and Business Practices Act to add regulation-making authority respecting gift cards or gift certificates.

The Bill would also repeal the Consumer Reporting Agencies Regulations. The Consumer Protection and Business Practices Act repealed and replaced the Consumer Reporting Agencies Act, and these regulations are no longer required.

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

        1. Section 106 of the Consumer Protection and Business Practices Act is amended by adding immediately after paragraph (h) the following:

          (h.1)  respecting gift cards or gift certificates, including imposing restrictions on or prohibiting the expiration of gift cards or gift certificates, and the fees which may be charged for them;
