EXPLANATORY NOTE

This Bill would amend the Provincial Offences Act to prohibit a ticket being issued under subsection 18.1(8) of the Act to a young person as defined in the Young Persons Offences Act in respect of an offence under the Highway Traffic Act or the Motorized Snow Vehicles and All-Terrain Vehicles Act.

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

        1. Section 18.1 of the Provincial Offences Act is amended by adding immediately after subsection (10) the following:

          (11)  Notwithstanding subsection (8), a peace officer or any other person having responsibility for the enforcement of a provision of an enactment shall not issue a ticket under subsection (8) to a young person as defined in the Young Persons Offences Act in respect of an offence under the Highway Traffic Act or the Motorized Snow Vehicles and All-Terrain Vehicles Act.
