Under the authority of subsection 55(2) of the Judicature Act , the Lieutenant-Governor in Council makes the following regulations.

Short title

        1. These regulations may be cited as the Supreme Court Fees Regulations .

Fees

        2. A person shall pay to the Supreme Court the fee listed in the Schedule for the service set out opposite the fee.

Waiver of fee

      2.1 (1) A clerk, officer or employee of the Supreme Court who performs a registry function may waive a fee under these regulations in whole or in part where an individual

             (a)  requests that the fee be waived; and

             (b)  provides proof satisfactory to the clerk, officer or employee that he or she is in receipt of income support under the Income and Employment Support Act .

             (2)  A judge of the Supreme Court may waive a fee under these regulations where

             (a)  an individual requests that the fee be waived; and

             (b)  after considering the individual's financial and other circumstances, the judge is satisfied that it is appropriate to waive the fee.

Rules of the Supreme Court, 1986 Amdt.

        3. Rule 55, Appendix, paragraph J of the Rules of the Supreme Court, 1986 is repealed.

Schedule

J. - FEES TO BE TAKEN BY THE SUPREME COURT

1.

For Letters of guardianship, administration of goods not administered, administration of a shared legacy, or other second or subsequent letters for the estate of a deceased person

For every exemplification of probate or letters of administration

For making copies of any will, pleading, affidavit or other document in the Registry, at the rate of $0.25 for every page or a part of a page. (Except that the Supreme Court may provide free of charge copies of the reasons for an order or judgment filed in a matter to every party to the matter; to publishers, law schools or other educational institutions whose primary objective is the dissemination of legal information; to courts and to those other persons or institutions the Supreme Court considers appropriate)
