Works, Services and Transportation Parking Regulations
under the
Works, Services and Transportation Act
(O.C. 96-191)

Under the authority of section 35 of the Works, Services and Transportation Act and the Subordinate Legislation Revision and Consolidation Act , the Lieutenant-Governor in Council makes the following regulations.

Short title

        1. These regulations may be cited as the Works, Services and Transportation Parking Regulations .

Definitions

        2. In these regulations

             (a)  "Act" means the Works, Services and Transportation Act ;

             (b)  "government grounds" means all land owned or occupied by the government of the province within the meaning of the Act;

             (c)  "motor cycle" means a motor cycle within the meaning of the Highway Traffic Act ;

             (d)  "motor vehicle" means a motor vehicle within the meaning of the Highway Traffic Act ;

             (e)  "no parking area" means

                      (i)  a part of the government grounds where signs are erected under subsection 35(7) of the Act to indicate that no parking is permitted,

                     (ii)  a part of the government grounds that are not covered by a hard surface, or

                    (iii)  a part of the government grounds that is a sidewalk, walkway or otherwise not intended for use by a motor vehicle or motor cycle;

              (f)  "park" means park within the meaning of the Highway Traffic Act ;

             (g)  "parking meter" means a device which shall indicate on it the length of time during which a vehicle may be parked and which shall have as a part of it a receptacle for receiving and storing coins, a slot or place in which the coins may be deposited, a timing mechanism to indicate the passage of the interval of time during which the parking is permissible and which shall also display a signal when the interval of time shall have elapsed;

             (h)  "permit" means a permit issued under subsection 35(4) of the Act; and

              (i)  "permit only area" means a part of the government grounds where signs erected under subsection 35(7) of the Act indicate that parking is not permitted except under permit.

No parking areas

        3. A person shall not park a motor vehicle or motor cycle in a no parking area.

Permit areas

        4. A person other than the holder of a permit shall not park a motor vehicle or motor cycle in a permit only area.

Interference with other vehicles

        5. A person shall not park a motor vehicle or motor cycle upon government grounds in a manner as to interfere with the parking of other motor vehicles or motor cycles or other motor vehicles or motor cycles attempting to enter upon or leave a portion of government grounds.

Parking meter spaces

        6. (1) A person shall not allow a vehicle to remain parked in a parking meter space for a period longer than that for which payment has been made by the driver or operator in the form of coins deposited in the parking meter adjacent to the parking space, but the driver or operator may park a vehicle in a parking space for the unexpired time remaining on the parking meter from its previous use without depositing a coin in the meter.

             (2)  A person shall not permit a vehicle to remain in a parking meter space while the signal "expired" or "violation" is in view on the parking meter.

Posted signs

        7. A person shall not park or operate a motor vehicle or motor cycle contrary to the instructions on a posted sign authorized by the Act or these regulations.

Permits

        8. Every person who holds a permit shall display that permit in the driver's side, lower portion of that vehicle's windshield.

Possession of vehicle without consent

        9. (1) The owner of a vehicle shall incur the penalties provided for a violation of these regulations with respect to a vehicle owned by him or her unless at the time of the violation the owner establishes that some person, other than the owner, was in possession of the vehicle without the consent of the owner.

             (2)  Nothing in this regulation shall relieve the driver or operator referred to in subsection (1) from incurring the penalties provided for a violation of these regulations.

Application

     10. It is ordered, under section 215 of the Highway Traffic Act , that the Highway Traffic Act applies to all government grounds.

Repeal

      11. The Department of Public Works and Services Parking Regulations, 1980, Newfoundland Regulation 318/80, are repealed.
