Under the authority of section 17 of the Mining Act , the Lieutenant Governor in Council makes the following regulations.

Short title

        1. These Regulations may be cited as the Small Scale Operations Regulations .

Definitions

        2. In this Act,

             (a)  "Act" means the Mining Act; and

             (a)  "guidelines" means the guidelines made by the minister under the Act and regulations.

Criteria prescribed

        3. The minister may, upon application, designate an operation as a small scale operation based on the ministers consideration of

             (a)  the nature of the materials mined or milled;

             (b)  the location of operation with respect to surface or underground mining;

             (c)  whether the operation requires a tailings impoundment area;

             (d)  the total volume or tonnage produced by the operation;

             (e)  the size of the area the operation affects; and

              (f)  those other particulars that may be described by the minister in the guidelines to the Act.
