Under the authority of section 120 of the Public Utilities Act, the Lieutenant-Governor in Council makes the following regulations.

Short title

        1. These regulations may be cited as the Public Utilities Regulations .

Definition

        2. In these regulations, "Act" means the Public Utilities Act .

Threshold amount

        3. For the purposes of subsection 41(3) of the Act, a public utility shall not proceed with the construction, purchase or lease of improvements or additions to its property without the prior approval of the board where

             (a)  the cost of the construction or purchase is in excess of $750,000; or

             (b)  the cost of the lease over the expected life of the lease is in excess of $750,000.

Commencement

        4. These regulations come into force on the date the Electrical Power Control (Amendment) Act, 1994 and Public Utilities (Amendment) Act comes into force.
