EXPLANATORY NOTES This Bill would amend the City of St. John's Act to provide that the deputy mayor or a councillor who wishes to run in a by-election for the vacated office of mayor must first resign as the deputy mayor or a councillor. In the event of a vacancy in the
office of the deputy mayor, a councillor who wishes to run must first resign. |
A AN ACT TO AMEND THE Analysis 1. S.15.3 Added Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows: RSNL1990 c-17 1. The City of St. John's Act is amended by adding immediately after section 15.2 the following: Requirement to resign seat 15.3 (1) Where a vacancy occurs in the office of the mayor, the deputy mayor or a councillor who wishes to run for election as mayor in a by-election shall first resign as the deputy mayor or a councillor. (2) Where a vacancy occurs in the office of the
deputy mayor, a councillor who wishes to run for election as the deputy mayor
in a by-election shall first resign as a councillor. (3) A resignation referred to in subsection (1) or
(2) shall be filed with the city clerk before the beginning of the notice
period set out in subsection 14(5) of the Municipal
