EXPLANATORY NOTE

This Bill would amend section 3 of the Teachers' Pensions Act to allow a member of the teachers' pension plan who is appointed to the position of the President of the Canadian Teachers' Federation to continue to participate in the pension plan during his or her term of office as president.  The amendment would be retroactive to September 1, 2005.

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

        1. Subsection 3(1) of the Teachers' Pensions Act is amended

             (a)  by striking out the word "or" at the end of paragraph (c);

             (b)  by striking out the period at the end of paragraph (d) and substituting a semi-colon and the word "or"; and

             (c)  by adding immediately after paragraph (d) the following:

             (e)  is a full time salaried president of the Canadian Teachers' Federation and who was before his or her appointment

                      (i)  a teacher to whom this Act or the former Act applied, or

                     (ii)  a public servant to whom the Public Service Pensions Act, 1991 applied, and

is considered to be, during his or her term of office as the president, a teacher for the purpose of the pension plan.

Commencement

        2. This Act shall be considered to have come into force on September  1, 2005.
