CHAPTER 16

AN ACT TO AMEND THE OCCUPATIONAL HEALTH AND SAFETY ACT

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

        1. (1) Paragraph 2(a) of the Occupational Health and Safety Act is repealed and the following substituted:

             (a)  "assistant deputy minister" means an assistant deputy minister appointed under section 9 of the Executive Council Act for the proper conduct of this Act;

             (2)  Paragraph 2(g) of the Act is repealed and the following substituted:

             (g)  "minister" means the minister appointed under the Executive Council Act to administer this Act;

 

        2. Section 70 of the Act is repealed and the following substituted:

Limitation period

      70. A prosecution under this Act or the regulations shall be started within 2 years of

             (a)  the date upon which the offence is alleged to have been committed; or

             (b)  the date upon which an assistant deputy minister or an officer of the Occupational Health and Safety Division becomes aware of the alleged offence,

whichever is later.
