Under the authority of section 38 of the Registered Nurses Act, 2008,
the council of the Association of Registered Nurses of Newfoundland and
Labrador
, with the approval of the Minister of Health and Community Services, makes the following regulations.

Short title
1.
These regulations may be cited as the Nurse Practitioner Regulations, 2009

Definitions
2.
In these regulations
(a)
"Act" means the Registered Nurses Act, 2008
;
(b)
"association" means the Association of Registered Nurses of Newfoundland and
Labrador
;
(c)
"nurse practitioner" means a nurse practitioner as defined in paragraph 2(f) of the Registered Nurses Act, 2008
;
(d)
"specialty nurse practitioner" means a registered nurse who meets the criteria for licensure as a speciality nurse practitioner established by the association and is issued a practice protocol; and
(e)
"standards committee" means the nurse practitioner standards committee established by the association under section 37 of the Act.

Standards of practice
3.
A nurse practitioner shall practise in accordance with the standards of practice established for nurse practitioners by the standards committee.

Statement of employment
4.
(1) A registered nurse shall, when he or she first applies to be registered as a nurse practitioner and, afterward, annually when he or she applies for a licence provide to the association,
(a)
where the nurse practitioner is an employee, provide the name of his or her employer and a statement from the employer stating the nurse practitioner, in the course of his or her employment, is able to consult with a physician concerning a patient in his or her care and is able to transfer the patient to a physician for care; or
(b)
where the nurse practitioner is not an employee, provide
(i)
the name and address of at least one physician with whom the nurse practitioner has an arrangement for the purpose of consultation with respect to the care of a patient and to whom he or she may transfer the patient for care, and
(ii)
a statement from the physician with whom the nurse practitioner has an arrangement stating that he or she is able to consult with the physician with respect to the care of the patient and that the patient may be transferred to the care of the physician.
(2)
A statement is not required under paragraph (1)(a) where the employer of a nurse practitioner has filed a statement with the association of all the nurse practitioners in its employ and stating that they are able to consult with a physician concerning patients in their care.
(3)
Where a nurse practitioner changes his or her employer, the nurse practitioner and the employer shall comply with paragraph (1)(a) before the nurse practitioner begins employment with the new employer.
(4)
Subsection (3) does not apply to an employer where he or she has filed a statement under subsection (2).

Authority of nurse practitioner
5.
A nurse practitioner may
(a)
order the application of a form of energy permitted by the practice standards or which he or she is authorized to order under a practice protocol issued to him or her;
(b)
order laboratory or other tests permitted by the practice standards or which he or she is permitted to order under a practice protocol; and
(c)
prescribe a drug permitted by the practice standards or which he or she is authorized to prescribe under a practice protocol.

Practice protocol
6.
(1) A nurse practitioner who wishes to practice as a speciality nurse practitioner shall apply to the standards committee for approval of a practice protocol.
(2)
A speciality nurse practitioner shall comply with the parameters of practice contained in his or her practice protocol.
(3)
A practice protocol is not transferable.
(4)
A practice protocol shall contain the information required by the standards committee.
(5)
The standards committee on the application of a speciality nurse practitioner and subject to the approval of his or her employer, may approve an amendment of the practice protocol applicable to the speciality nurse practitioner.
