Fire Prevention Fireworks Regulations
under the
Fire Prevention Act, 1991
(O.C. 96-214)

Under the authority of section 26 of the Fire Prevention Act, 1991, and the Subordinate Legislation Revision and Consolidation Act, the Lieutenant-Governor in Council makes the following regulations.

Short title

        1. These regulations may be cited as the Fire Prevention Fireworks Regulations.

Definitions

        2. In these regulations

             (a)  "aerial type fireworks" means recreational high hazard fireworks that are projected off the ground such as rockets, bombshells, barrage, etc.;

             (b)  "family fireworks" means a type of recreational low hazard fireworks; and

             (c)  "firework" means a manufactured firework as defined in the regulations under the Explosives Act (Canada).

Permit required for sale

        3. A person shall not offer or hold for sale a firework without a permit from the fire commissioner authorizing the storage and sale of that firework.

Discharge of aerial type firework

        4. (1) A person shall not discharge aerial type fireworks unless a permit from the fire commissioner is obtained authorizing the discharge or display.

             (2)  A permit issued for outside discharge or display of an aerial type of fireworks is valid only for the date and area for which it is issued.

             (3)  The discharge or display of an aerial type of fireworks shall be under the direction of a person holding a valid supervisor card issued by the Explosives Branch, Energy Mines and Resources, Canada.

Discharge inside a building

        5. (1) A person shall not discharge a firework inside a building.

             (2)  Notwithstanding subsection (1), the fire commissioner may issue a permit for the discharge of fireworks within a building for special occasions, such as a theatrical performance, and may stipulate the conditions under which that discharge may be permitted.

Family fireworks

        6. A permit is not required for a discharge or display of family fireworks as long as the person in charge of the discharge or display

             (a)  is over 18 years of age;

             (b)  discharges the fireworks in accordance with instructions printed on each item or package; and

             (c)  exercises care and caution in respect of fire.

Requirements of federal agencies

        7. The fire commissioner may issue a permit for the storage and sale of fireworks, providing all the requirements of the federal agencies concerned are met.

Suspension or cancellation of permit

        8. The fire commissioner may suspend or cancel a permit issued by him or her.

Duration of permit

        9. A permit for the storage or sale of fireworks is valid until the end of the calendar year in which it is issued unless sooner cancelled or suspended.

Fireworks to be federally authorized

     10. Only fireworks that have been authorized by the Federal Explosives Branch, Canada, are allowed to be stored, sold or used.

Repeal

      11. The Fire Prevention (Fireworks) Regulations, 1984, Newfoundland Regulation 275/84, are repealed.
