Shops' Closing Regulations
under the
Shops' Closing Act
(O.C. 96-864)

Under the authority of paragraph 10(a) of the Shops' Closing Act and the Subordinate Legislation Revision and Consolidation Act , the Lieutenant-Governor in Council makes the following regulations.

Short title

        1. These regulations may be cited as the Shops' Closing Regulations.

Exempt shops

   2. (1) For the purpose of paragraph 2(b) of the Shops' Closing Act, the following classes of shops are exempt shops:

             (a)  art galleries;

             (b)  automatic laundries;

             (c)  neighbourhood convenience stores;

             (d)  bookshops;

             (e)  newsstands;

             (f)  motor vehicle service stations;

             (g)  vehicle rental outlets;

             (h)  restaurants and food take-outs;

              (i)  video rental outlets;

              (j)  pharmacies;

             (k)  shops where the primary and most substantial business relates to the sale of fresh fruit, flowers, vegetables, plants or gardening supplies;

              (l)  shops where the primary and most substantial business relates to souvenirs or to crafts;

           (m)  music shops where the primary and most substantial business relates to the sale of recorded music such as records, compact disks and taped music;

             (n)  gift stores in hospitals or in an institution or facility which is under the management and control of a hospital board; and

             (o)  retail shops that provide services essential to the life, health or personal safety of individuals and animals including

                      (i)  food,

                     (ii)  pharmaceutical products, medicine and medical devices,

                    (iii)  personal hygiene products,

                    (iv)  cleaning products,

                     (v)  baby and child products,

                    (vi)  gas stations,

                   (vii)  computer and cellphone service and repair,

                  (viii)  electronic and office supplies,

                    (ix)  hardware supplies, and

                     (x)  pet and animal supplies.

             (2)  Paragraph (1)(o) shall be repealed on April 11, 2020.

Repeal

        3. The Shops' Closing Regulations, 1992, Newfoundland Regulation 6/93, are repealed.
