Analysis
Short title
1.
This Order may be cited as the Newfoundland Pony Designation Order
.

Heritage animal designated
2.
The Newfoundland Pony is designated as a heritage animal under section 4 of the Heritage Animals Act.

Characteristics of Newfoundland Pony
3.
For the purpose of this Order, the Newfoundland Pony is a vertebrate of the species Equus caballus
that
(a)
stands from 11.0 to 14.2 hands in height;
(b)
has a body structure that may vary from fine-boned to stocky;
(c)
has a black, brown, grey, chestnut, white or bays to roan colour, but is not piebald or skewbald in colour;
(d)
has a heavy coat that may change colour and character seasonally, feathered fetlocks with hair extending below the fetlock points, flint hard hooves, a thick low set tail and thick mane;
(e)
is sure footed and is a good winter animal;
(f)
has a good temperament;
(g)
has dark limb points, but may also have white or light colour on the animals limbs;
(h)
is free from hereditary defects which endanger the animals ability to live a normal healthy life; and
(i)
was born in the province or whose ancestry may be traced to the province.

Society designated
4.
The Newfoundland Pony Society is designated as a society to act in the preservation of the Newfoundland Pony under paragraph 6(1)(a) of the Act and shall carry out the objects and the duties described in sections 7 and 8 of the Act.

Transitional
5.
All persons owning, leasing, otherwise possessing, or acquiring or coming into possession of a Newfoundland Pony within 30 days of the coming into force of this Order are required within 60 days of the coming into force of this Order to submit to the registry established by the society for that purpose, details of the ownership, location and age of every Newfoundland Pony or the offspring of every Newfoundland Pony in that persons ownership or possession on a form prescribed by the society for that purpose.

Reporting required
6.
After the transitional period established in section 5 has expired, whenever a Newfoundland Pony is destroyed, disposed of, sold, bartered, or traded, the owner, any person in possession of the Newfoundland Pony or a person who acquires ownership or possession of a Newfoundland Pony shall submit within 30 days of the occurrence of that event to the society the full details and particulars of the event to the registry established by the society on the form prescribed by the society for that purpose.

Removal prohibited
7.
A person shall not, without the ministers consent, remove a Newfoundland Pony from the province.

Record disposal prohibited
8.
A person shall not dispose of any record filed with the Registry of Newfoundland Ponies.

Fees to be approved
9.
All fees for the registration of a Newfoundland Pony imposed by the society under paragraph 8(c) of the Act shall be subject to the prior approval of the minister.

Offence
10.
A person shall not provide false or misleading information to the minister, the ministers designates, or to the Registry of Newfoundland Ponies.

Commencement
11.
This Order shall come into force on
September 15, 1997
