Short title

        1. This Order may be cited as the Off-road Vehicle Operation in the T’Railway Provincial Park Prohibition Order.

Off-road vehicles prohibited

        2. The use of off-road vehicles in the Newfoundland and Labrador T'Railway Provincial Park is prohibited

             (a)  in those portions of the park lying within the boundaries of the City of St. John's and the City of Mount Pearl and continuing westward within the municipal boundary of the Town of Paradise, until the park intersects with the McNamara Road in that municipality; and

             (b)  in the area set out in the Schedule.

Prohibition when fire weather index high, very high or extreme

        3. (1) The use of off-road vehicles in the Newfoundland and Labrador T'Railway Provincial Park is prohibited when the fire weather index is high, very high or extreme.

             (2)  Notwithstanding subsection (1), f or the purposes of exiting the Newfoundland and Labrador T'Railway Provincial Park , a person may, on or before 11:59 on August 15, 2025, operate an off-road vehicle in the Newfoundland and Labrador T'Railway Provincial Park when the fire weather index is high, very high or extreme where

             (a)  the person is in the Newfoundland and Labrador T'Railway Provincial Park on the coming into force of this section; and

             (b)  the operation of an off-road vehicle is required for the person to exit the Newfoundland and Labrador T'Railway Provincial Park.

             (3)  This section does not apply to officers or authorized park employees in the course of their duties.         

             (4)  This section is repealed at 11:59 p.m. on August 17, 2025.

Schedule

All that piece or parcel of land situate and being in the Town of Conception Bay South in the province of Newfoundland and Labrador, in the Electoral Districts of Topsail-Paradise, Conception Bay South and Harbour Main, abutted and bounded as follows, that is to say :

Beginning at a point on the centreline of the Newfoundland and Labrador T'Railway Provincial Park approximately 160 metres northeast of its intersection with Spruce Hill Road having coordinates east 355,137 metres, north 5,265,340 metres, more or less;

Then along the centreline of the Newfoundland and Labrador T'Railway Provincial Park, and including all right of way lands, in a general southwesterly direction for a distance of 18.3 kilometres ending at a point near Indian Pond having coordinates east 342,561 metres, north 5,258,452 metres, more or less;

As delineated at the Registry of Crown Titles in Special Plans 18 and 19.

All bearings and coordinates being referred to the meridian of the 51   ° west longitude of the 6   ° Transverse Mercator Projection, North American Datum 1983.
