EXPLANATORY NOTES

Clause 1 of the Bill would amend the Highway Traffic Act to provide that the provision requiring the Registrar of Motor Vehicles not to issue to or renew a driver's licence or a vehicle registration for a person who has failed to pay a fine does not apply where the fine relates to a conviction for a violation of a regulations made under the City of St. John's Act, the City of Corner Brook Act, the City of Mount Pearl Act, the Municipalities Act, 1999 or the Urban and Rural Planning Act, 2000 that does not involve the operation of a motor vehicle.

Clause 2 of the Bill would amend the Provincial Offences Act to provide that the provision requiring a judge who convicts a person of an offence initiated by a ticket to notify the Registrar of Motor Vehicles of the conviction does not apply to a conviction for a violation of a regulation made under the City of St. John's Act, the City of Corner Brook Act, the City of Mount Pearl Act, the Municipalities Act, 1999 or the Urban and Rural Planning Act, 2000 that does not involve the operation of a motor vehicle.

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

1. Section 16.1 of the Highway Traffic Act is amended by renumbering it as subsection 16.1(1) and by adding immediately after subsection (1) the following:

(2) Subsection (1) does not apply to a person who has failed to pay a fine relating to a conviction for a violation of a regulation made under the City of St. John's Act, the City of Corner Brook Act, the City of Mount Pearl Act, the Municipalities Act, 1999 or the Urban and Rural Planning Act, 2000 that does not involve the operation of a motor vehicle.

2. Section 27 of the Provincial Offences Act is amended by renumbering it as subsection 27(1) and by adding immediately after subsection (1) the following:

(2) Subsection (1) does not apply to a conviction for a violation of a regulation made under the City of St. John's Act, the City of Corner Brook Act, the City of Mount Pearl Act, the Municipalities Act, 1999 or the Urban and Rural Planning Act, 2000 that does not involve the operation of a motor vehicle.
