EXPLANATORY NOTES

This Bill would amend the Pharmacy Act.

Clause 1 of the Bill would amend the Act to expand the definition of "prescription" to include a prescription authorized by a prescriber practicing outside the province.

Clause 2 of the Bill would add a new section to the Act to set out what a pharmacist must do before filling a prescription authorized by a prescriber practicing outside the province.

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

        1. Paragraph 2(p) of the Pharmacy Act is amended by striking out the word "or" at the end of subparagraphs (ii) and (iii.1), by adding at the end of subparagraph (iv) the word "or" and by adding immediately after that subparagraph the following:

                     (v)  a prescriber licensed to practice in a province or territory of Canada other than Newfoundland and Labrador, in accordance with section 24.1,

 

        2. The Act is amended by adding immediately after section 24 the following:

Out of province prescriptions

   24.1 A pharmacist may dispense a drug pursuant to a prescription authorized by a prescriber licensed to practice in a province or territory of Canada other than Newfoundland and Labrador if the pharmacist has taken reasonable steps to ensure that

             (a)  the prescriber is licensed and practises in Canada; and

             (b)  the prescriber belongs to a class of persons who, if licensed in Newfoundland and Labrador, would be entitled by law to prescribe that drug in Newfoundland and Labrador.
