EXPLANATORY NOTES

This Bill would amend the Regional Service Boards Act, 2012 to

·         require the Lieutenant-Governor in Council to appoint the chairperson of each regional service board;

·         set a term of 4 years for chairpersons of regional service boards; and

·         allow the Lieutenant-Governor in Council to dismiss a chairperson of a regional service board.

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

        1. Subparagraph 2(e)(i) of the Regional Service Boards Act, 2012 is repealed and the following substituted:

                      (i)  a chairperson appointed to a board under section 5, and

 

        2. Subsection 5(1) of the Act is repealed and the following substituted:

Chairperson and vice-chairperson

        5. (1) The Lieutenant-Governor in Council shall, on the recommendation of the minister, appoint a chairperson to each board for a 4 year term.

         (1.1)  Notwithstanding subsection (1), the Lieutenant-Governor in Council may dismiss a chairperson from a board.

         (1.2)  A chairperson appointed under subsection (1) is eligible for reappointment.

         (1.4)  Notwithstanding subsection (1), a chairperson of a board shall continue to be the chairperson until he or she is reappointed, replaced or dismissed.

                 

 

        3. Subsection 6(4) of the Act is repealed and the following substituted:

             (4)  In this section, "member" means a person appointed or elected to a board under this section but does not include a chairperson appointed to a board under section 5.

 

        4. (1) Subsection 8(4) of the Act is repealed.

             (2)  Subsection 8(5) of the Act is repealed and the following substituted:

             (5)  Notwithstanding subsections (1) to (3), a member shall continue to be a member until he or she is reappointed, re-elected or replaced.

        5. The Schedule to the Independent Appointments Commission Act is amended by adding immediately after the statutory appointment reference "Regional Health Authorities Act, Regional Health Authorities Regulations, subsection 3(3)" the statutory appointment reference "Regional Service Boards Act, 2012, subsection 5(1)".

Transitional

        6. A person who is the chairperson of a board on the coming into force of this Act continues to be the chairperson of the board until reappointed, replaced or dismissed.
