EXPLANATORY NOTES

General: The purpose of this Bill is to bring before the House of Assembly matters in the statute law that require legislative correction as a result of amendments or enactments made in previous sessions. The amendments contained in this Bill have been brought to the attention of the Minister of Justice and Public Safety and are technical amendments not involving matters of policy. Each amendment is explained by reference to the clause of the Bill by which it is proposed.

Clause 1 of the Bill is the short title.

Clause 2 of the Bill would amend paragraph 85(3)(b) of the Access to Information and Protection of Privacy Act, 2015 to delete a reference to “clerk assistant”. The position of clerk assistant was eliminated in recent organizational changes in the House of Assembly service.

Clause 3(1) of the Bill would amend subsection 179.19(4) of the Canada-Newfoundland and Labrador Atlantic Accord Implementation and Offshore Renewable Energy Management Newfoundland and Labrador Act to correct 2 typographical errors. The reference to "federal minister" is corrected to "provincial minister" and the reference to "provincial minister's" is corrected to "federal minister's".

Clause 3(2) of the Bill would amend subsection 201.84(3) of the Canada-Newfoundland and Labrador Atlantic Accord Implementation and Offshore Renewable Energy Management Newfoundland and Labrador Act to replace the words “him or her”. This provision was inadvertently omitted when similar amendments relating to gender-neutral language were made to the Act in 2025.

Clause 4(1) of the Bill would amend paragraph 7(2)(a) of the Councillor Remuneration and Reimbursement Regulations to correct an error in cross-referencing.

Clause 4(2) of the Bill would amend paragraph 7(2)(b) of the Councillor Remuneration and Reimbursement Regulations to correct an error in cross-referencing.

Clause 5 of the Bill would amend subsection 14(8) of the Denturists Act, 2005 to correct an incorrect reference to another Act. The error arose when the Public Inquiries Act was replaced by the Public Inquiries Act, 2006.

Clause 6 of the Bill would amend subsection 22(9) of the Dietitians Act to correct an incorrect reference to another Act. The error arose when the Public Inquiries Act was replaced by the Public Inquiries Act, 2006.

Clause 7(1) of the Bill would amend paragraph 3(a) of the Dispensing Opticians Act, 2005 to correct an incorrect reference to another Act. The error arose when the Medical Act, 2005 was replaced by the Medical Act, 2011.

Clause 7(2) of the Bill would amend subsection 13(9) of the Dispensing Opticians Act, 2005 to correct an incorrect reference to another Act. The error arose when the Public Inquiries Act was replaced by the Public Inquiries Act, 2006.

Clause 8 of the Bill would amend subparagraph 2(b)(ii) of the Gunshot and Stab Wound Reporting Act to correct an incorrect reference to another Act. The error arose when the Medical Act, 2005 was replaced by the Medical Act, 2011.

Clause 9 of the Bill would amend subsection 13(10) of the Hearing Aid Practitioners Act to correct an incorrect reference to another Act. The error arose when the Public Inquiries Act was replaced by the Public Inquiries Act, 2006.

Clause 10(1) of the Bill would amend the Schedule to the Independent Appointments Commission Act to correct an error in cross-referencing.

Clause 10(2) of the Bill would amend the Schedule to the  Independent Appointments Commission Act to remove a reference to a regulation that has been repealed.

Clause 11 of the Bill would amend paragraph 2(b) of the Innkeepers Act to correct a typographical error. The reference to “or a price” is corrected to “for a price”.

Clause 12 of the Bill would amend subsection 17(4) of the Liquor Licensing Regulations to correct a typographical error. The reference to “granting” is corrected to “issuing”.

Clause 13 of the Bill would amend paragraph 2(1)(c) of the Management of Greenhouse Gas Administrative Penalty Regulations to include a reference to subsection 5.1(2) of the Management of Greenhouse Gas Regulations which was inadvertently omitted when the Management of Greenhouse Gas Regulations were amended to add section 5.1.

Clause 14 of the Bill would amend paragraph 20.1(4)(a) of the Management of Greenhouse Gas Reporting Regulations to correct an error in cross-referencing.

Clause 15 of the Bill would amend subsection 14(8) of the Massage Therapy Act, 2005 to correct an incorrect reference to another Act. The error arose when the Public Inquiries Act was replaced by the Public Inquiries Act, 2006.

Clause 16 of the Bill would amend section 2.1 of the Mechanics' Lien Act to correct a typographical error. The reference to "Labrador Inuit Agreement Act" is corrected to "Labrador Inuit Land Claims Agreement Act".

Clause 17 of the Bill would amend subparagraph 2(n)(i) of the Medical Radiation Technologists Regulations to correct a typographical error. The reference to “optical” is corrected to “optimal”.

Clause 18 of the Bill would amend subsection 14(9) of the Occupational Therapists Act, 2005 to correct an incorrect reference to another Act. The error arose when the Public Inquiries Act was replaced by the Public Inquiries Act, 2006.

Clause 19 of the Bill would amend column 1 of item 1 in section 5 of the Offshore Petroleum Administrative Monetary Penalties Regulations to correct references to 2 regulators.

Clause 20(1) of the Bill would amend paragraph 4(2)(b) of the Offshore Petroleum Financial Requirements Regulations to correct an incorrect reference to an Act. The error arose when the name of the "Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation Act" was amended to the "Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation and Offshore Renewable Energy Management (Nova Scotia) Act".

Clause 20(2) of the Bill would amend paragraph 4(2)(c) of the Offshore Petroleum Financial Requirements Regulations to correct an incorrect reference to an Act. The error arose when the name of the "Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation Act" was amended to the "Canada-Nova Scotia Offshore Petroleum Resources Accord Implementation and Offshore Renewable Energy Management (Nova Scotia) Act".

Clause 21 of the Bill would amend subsection 16(9) of the Physiotherapy Act, 2006 to correct an incorrect reference to another Act. The error arose when the Public Inquiries Act was replaced by the Public Inquiries Act, 2006.

Clause 22 of the Bill would amend subsection 11(3) of the Provincial Parks Regulations to correct an incorrect reference to a regulation. The error arose when the Motorized Snow Vehicles and All-Terrain Vehicles Regulations were replaced by the Off-Road Vehicles Regulations.

Clause 23 of the Bill would amend subparagraph 2(1)(oo)(iv) of the Securities Act to correct an error in cross-referencing.

Clause 24(1) of the Bill would amend paragraph 88(4)(a) of the Towns and Local Service Districts Act to correct a typographical error. The reference to “with” is corrected to “which the”.

Clause 24(2) of the Bill would amend paragraph 99(4)(b) of the Towns and Local Service Districts Act to correct an error in cross-referencing.

Clause 24(3) of the Bill would amend subsection 103(1) of the Towns and Local Service Districts Act to add a quotation mark that was inadvertently omitted.

Clause 24(4) of the Bill would amend subsection 285(7) of the Towns and Local Service Districts Act to correct a typographical error. The reference to “marshal” is corrected to “commissioner”.

Clause 24(5) of the Bill would amend subsection 286(5) of the Towns and Local Service Districts Act to correct a typographical error. The reference to “marshal” is corrected to “commissioner”.

Clause 25 of the Bill would repeal a number of obsolete or spent Acts and regulations.

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

Short title

        1. This Act may be cited as the Attorney General Statutes Amendment Act, 2026.

SNL2015 cA-1.2 Amdt.

        2. Paragraph 85(3)(b) of the Access to Information and Protection of Privacy Act, 2015 is amended by deleting the words "the Clerk Assistant of the House of Assembly" and substituting the words "the person appointed under paragraph 10(1)(b) of the House of Assembly Accountability, Integrity and Administration Act".

        3. (1) Subsection 179.19(4) of the Canada-Newfoundland and Labrador Atlantic Accord Implementation and Offshore Renewable Energy Management Newfoundland and Labrador Act is amended by
