Offshore Area Oil and Gas Operations Regulations
CNLR 1/96; 2001 c42 s45 Under the authority of section 145 of the Canada-Newfoundland and Labrador Atlantic Accord Implementation Newfoundland and Labrador Act and the Subordinate Legislation Revision and Consolidation Act , the Lieutenant-Governor in Council makes the following regulations. REGULATIONS Short title 1. These regulations may be cited as the Offshore Area Oil and Gas Operations Regulations. Definitions 2. In these regulations
(a)
"Act" means the Canada?Newfoundland and
(b) "operating licence" means a licence issued under section 134 of the Act. 103/88 s2; 2001 c42 s45 Operating licences 3. (1) An application for an operating licence may be made by (a) an individual who is 18 years of age or over; (b) a corporation registered or continued under the Corporations Act ; or (c) a corporation that is entitled to carry on business in any province. (2) Every application for an operating licence shall (a) be in writing; (b) contain the name and address of the applicant; (c) be forwarded to the chief conservation officer; and
(d)
be accompanied by a fee of $25 made payable to the Receiver General of
Assignment or transfer void 4. A person shall not assign or transfer an operating licence and a purported assignment or transfer of an operating licence is void. Express authorization for studies 5. A holder of an operating licence shall not carry out a geotechnical or engineering feasibility program, environmental study, geophysical or geological program, diving program or other work or activity that is required by the Act to be authorized unless (a) that work or activity is expressly authorized pursuant to regulations under the Act; or (b) the holder has applied for and obtained a written authorization under paragraph 134(1)(b) of the Act. Reporting spills 6. A person who under subsection 156(2) of the Act reports a spill shall do so by informing the chief conservation officer immediately of the circumstances and relevant details of the spill by the most rapid practical means. Repeal 7. The Newfoundland Offshore Area Oil and Gas Operations Regulations, Newfoundland Regulation 103/88, are repealed. ©Earl G. Tucker, Queen's Printer |
