Short title

        1. These regulations may be cited as the Egg Grading and Inspection Regulations .

Definitions

        2. In these regulations

             (a)  "consumer" means a person who buys eggs or cracked eggs for his or her own use;

             (b)  "cracked egg" means an egg which

                      (i)  shows on candling a distinct yolk outline,

                     (ii)  shows on candling a yolk that is moderately oblong in shape and that floats freely within the egg when twirled,

                    (iii)  shows on candling a very slight degree of germ development,

                    (iv)  shows on candling an air cell not in excess of 9 millimetres in depth,

                     (v)  shows spots of dirt on the shell, if the aggregate area of dirt does not exceed 40 square millimetres, and stain spots, if the aggregate area of the stain does not exceed 320 square millimetres,

                    (vi)  has a shell that is slightly abnormal in shape and has rough areas and definite ridges, or

                   (vii)  has a hairline crack in the shell, where the membrane is not broken and the internal contents are not leaking;

             (c)  "domestic hen" means a hen belonging to the species Gallus Domesticus ;

             (d)  "egg" means egg of a domestic hen, but does not include a cracked egg;

             (e)  "producer" means a person who sells eggs that are produced on a farm which he or she operates, but does not include a retail seller or a person who ships, transports, or sells eggs that are not produced on his or her farm; and

              (f)  "retail seller" means a person who sells eggs at a place of business constructed or operated principally for the purpose of selling commodities or products to consumers.

Health and safety standards

        3. (1) Eggs shall be inspected and graded at egg grading stations or other facilities designated by the minister.

             (2)  Eggs inspected or graded under subsection (1) shall meet health, safety, packaging and labelling standards prescribed by the Egg Regulations (Canada) made under the Canada Agricultural Products Act (Canada) before those eggs are marketed, offered for sale or incorporated into any food product that is marketed for human consumption.

             (3)  Following inspection and grading under subsection (1), eggs that are to be marketed or sold for human consumption shall be stored in accordance with the temperature and humidity conditions which are prescribed by the Egg Regulations (Canada) made under theCanada Agricultural Products Act (Canada).

             (4)  Eggs marked with the name of a foreign country, and a grade name of that foreign country, are exempt from the application of subsection 3(1) where those eggs meet the standard for the Canada grade equivalent to the grade name on the container.

Cracked eggs

        4. (1) The sale of cracked eggs is prohibited except where

             (a)  the cracked eggs are purchased by a consumer;

             (b)  the cracked eggs are inspected and graded at egg grading stations or other facilities designated by the minister;

             (c)  the packaging is sufficient to avoid contamination or adulteration;

             (d)  the labelling clearly identifies the cracked eggs as "Newfoundland and Labrador cracks" and identifies the producer of the cracked eggs;

             (e)  the cracked eggs are stored at a temperature of 4° Celsius or less prior to sale;

              (f)  the labelling clearly indicates that the cracked eggs must be cooked thoroughly prior to human or animal consumption; and

             (g)  the labelling of trays and cartons of cracked eggs bear the instruction "keep refrigerated at 4° Celsius or less".

             (2)  The incorporation of cracked eggs into a food product marketed for human consumption is prohibited.

Exemption

        5. Sections 3 and 4 do not apply to eggs or cracked eggs that are sold by producers to consumers.

Repeal

        6. The Regulations respecting the Grading, Packing, Marking, Inspection, Advertising and Sale of Eggs, 1978, Newfoundland Regulation 57/78, and the Newfoundland Hatchery Regulations, 1965, Newfoundland Regulation 127/78, are repealed.
