Forest Fire Offence and Penalty Regulations
under the
Forestry Act
(O.C. 96-178)

Under the authority of section 155 of the Forestry Act and the Subordinate Legislation Revision and Consolidation Act, the Lieutenant-Governor in Council makes the following regulations.

Short title

        1. These regulations may be cited as the Forest Fire Offence and Penalty Regulations.

Offence

        2. A person who

             (a)  contravenes the Forest Fire Regulations; or

             (b)  fails to comply with a permit or a condition of a permit issued under the Forestry Act or the Forest Fire Regulations;

is guilty of an offence and liable

             (c)  where the complaint is laid and summons issued by a means of a ticket

                      (i)  for a first offence, to a fine of $50,000 or, in default of payment, imprisonment for not more than 6 months, and

                     (ii)  for a subsequent offence, to a fine of $75,000 or, in default of payment, imprisonment for not more than 6 months; or

             (d)  where the complaint is laid and summons issued by means other than a ticket

                      (i)  for a first offence, to a fine of not less than $50,000 and not more than $100,000 or, in default of payment, imprisonment for not more than one year, and

                     (ii)  for a subsequent offence, to a fine of not less than $75,000 and not more than $150,000 or, in default of payment, imprisonment for not more than one year.

Repeal

        3. The Forest Fire Offence and Penalty Regulations, 1994, Newfoundland Regulation 161/94, are repealed.
