EXPLANATORY NOTE

The purpose of this Bill is to add a provision to the regulation making section 111 of the Environmental Protection Act to allow the making of regulations with respect to ticketable offences under that Act. The amendment would also amend section 115 of the Act to allow the establishment of penalties for those ticketable offences.

Be it enacted by the Lieutenant-Governor and House of Assembly in Legislative Session convened, as follows:

SNL2002 cE-14.2 as amended

        1. Subsection 111(1) of the Environmental Protection Act is amended by adding immediately after paragraph (rr) the following:

         (rr.1)  respecting ticketable offences and penalties for those offences;

 

        2. Section 115 of the Act is amended by adding immediately after subsection (6) the following:

             (7)  Notwithstanding subsection (1), where, with respect to an offence under this Act or regulations made under this Act, other than under subsection 114(2), a complaint is laid and a summons issued by means of a ticket in accordance with the Provincial Offences Act, a person found guilty of that offence is liable on summary conviction to a fine that may be established by regulation.
